Comic Book Legal Defense Fund Urges Supreme Court to Reject
New Restrictions on Speech in Video Game Censorship Case

Washington, DC -- Comic Book Legal Defense Fund, a not-for-profit organization that defends the First Amendment rights of the comic book industry, today filed a friend-of-the-court brief in Schwarzenegger v. EMA, urging the Supreme Court to affirm the Ninth Circuit's decision that a California law banning the sale or rental of any video game containing violent content to minors, and requiring manufacturers to label such games, is unconstitutional.

The Comic Book Legal Defense Fund submits that, if allowed to stand, California's law would reverse fundamental First Amendment principles by creating a new category of unprotected speech, diminishing the First Amendment rights of minors, and reducing First Amendment protection for new media. The CBLDF argues that the law under review is the most recent example of government improperly attempting to regulate content by using junk science, and calls upon a history of moral panics against media that includes the 1950s crusades against comics that crippled the industry and harmed the art form. The CBLDF asks the Supreme Court to deny California this attempt to roll back protections guaranteed by the First Amendment, as it and other courts have correctly done in the past.

Charles Brownstein, Executive Director of CBLDF, says "The case California makes against video games is one familiar to the comic book industry, which was nearly destroyed by government attempts at regulation in the 1950s. Then, as now, moral crusaders claimed that popular new media containing depictions of violence were detrimental to our youth. Then, as now, pseudo-science was used to back such claims. Those claims weren't true in the 1950s, and they aren't true now."

Brownstein adds, "We hope that the Supreme Court denies California's attempt to diminish the First Amendment, and spares the video game industry the fate that was suffered by the comic book industry in the past. We also encourage them to deny California's claims so that comic books and other media don't suffer under a new constitutional standard that creates new categories of unprotected speech and diminishes the First Amendment rights of minors."

At issue in Schwarzenegger v. EMA is a challenge to a California video game law, enacted in 2005, that prohibited the sale or rental to minors of any video game containing certain violent content. The law -- blocked by a federal judge in 2006 before it took effect -- also required such manufacturers to include an "18 and older" warning label on the front of the package and provides civil penalties of up to $1,000 for violations. In 2008, CBLDF, as part of Media Coalition, filed a friend-of-the-court brief with the Ninth Circuit Court of Appeals in support of the respondent in today's case, arguing that speech with violent content could not be regulated by the government and that the labeling requirement was unconstitutional as compelled speech. Last year, a three-judge panel of the Ninth Circuit ruled unanimously that the law violates the First Amendment.

Ape Entertainment to Publish Comic Books Inspired by DreamWorks Animation Films Megamind and Kung Fu Panda 2

FANTAGRAPHICS ACQUIRES LOST ‘GRAPHIC NOVEL’ BY WILLIAM S. BURROUGHS & ARTIST MALCOLM McNEILL

SEATTLE, WA, SEPT. 9, 2010 --- Fantagraphics Books is proud to announce the acquisition of the only graphic novel written by — and possibly the last unseen work of his to be published — the innovative Beat writer and Naked Lunch author, William S. Burroughs. This lost masterpiece, Ah Pook Is Here, created in collaboration with artist Malcolm McNeill in the 1970s, will be published in the summer of 2011 as a spectacularly packaged two-volume, hinged set, along with Observed While Falling, McNeill’s memoir documenting his collaboration with one of America’s most iconic authors.

Ah Pook Is Here first appeared in 1970 under the title The Unspeakable Mr. Hart as a monthly comic strip written by Burroughs and drawn by the British cartoonist and painter Malcolm McNeil in the English magazine Cyclops. When the publication folded, Burroughs and McNeill decided to develop the project into a full-length, Word/Image novel (the term ‘graphic novel’ had not yet been coined). Burroughs was 56 at the time, McNeill 23.

The book was conceived as a single painting in which text and images were combined in whatever form seemed appropriate to the narrative. It was conceived as 120 continuous pages that would ‘fold out.’ Such a book was, at the time, unprecedented, and no publisher was willing to take a chance and publish a ‘graphic novel.’ Burroughs and McNeill finally abandoned the project after collaborating on it for 7 years.

“It is singularly appropriate that after championing literate comics and the graphic novel form for over 30 years, Fantagraphics Books should bring a literary collaboration between one of America’s most distinctive writers and his exemplary hand-chosen artist to light,” says Fantagraphics Publisher and acquiring editor Gary Groth.

Ah Pook Is Here is a consideration of time with respect to the differing perceptions of the ancient Maya and that of the current Western mindset. It was Burroughs’ contention that both of these views result in systems of control in which the elite perpetuate its agendas at the expense of the people. They make time for themselves and through increasing measures of Control attempt to prolong the process indefinitely.

John Stanley Hart is the “Ugly American” or “Instrument of Control” — a billionaire newspaper tycoon obsessed with discovering the means for achieving immortality. Based on the formulae contained in rediscovered Mayan books he attempts to create a Media Control Machine using the images of Fear and Death. By increasing Control, however, he devalues time and invokes an implacable enemy: Ah Pook, the Mayan Death God. Young mutant heroes using the same Mayan formulae travel through time bringing biologic plagues from the remote past to destroy Hart and his Judeo/Christian temporal reality.

Ah Pook Is Here was an experiment, not just in terms of the form in which the idea was expressed but the possible effects the form might produce. Burroughs was preoccupied throughout his career with the fundamental nature of words and images, particularly with regard to their ability to transcend time. In the case of Ah Pook Is Here, the rapport between artist and writer produced results that confirmed that contention. Ah Pook is the kind of extrapolative, futuristic feat of imagination that a reader would expect from the author of Nova Express and The Ticket That Exploded — a mind-boggling tour de force, dramatizing outrĆ© theories with a science fiction patina.

The second book in the set is Observed While Falling, written by Malcolm McNeill, an account of the personal and creative interaction that defined the collaboration between the writer and the artist, the events surrounding it, and the reasons for its ultimate demise. McNeill describes his growing friendship with Burroughs and how their personal relationship affected their creative partnership. The book is written with insight and humor, and liberally sprinkled with the kind of the hilarious anecdotes one would expect working with a writer as original and eccentric as William S. Burroughs. It confirms the prescience of Ah Pook Is Here with respect to the contemporary graphic novel; Burroughs' exploration of the artistic potential of combining words and images was a revelation to the artist. The book offers new insights into Burroughs’ working methods as well as how the two explored the possibilities of words and images working together to form the ambitious literary hybrid that they didn’t know, at the time, was a harbinger of the 21st century’s “graphic novel.”

The November debut of STAN LEE'S THE TRAVELER #1 will mark the second of three titles debuting from Stan Lee and BOOM! Debuting in October, one month before THE TRAVELER, is STAN LEE'S SOLDIER ZERO. Hitting shelves this December is STAN LEE'S STARBORN. The third of the three ongoing series is written by iZOMBIE's Chris Roberson — who recently charted as a New York Times best-selling author — featuring art by SPIDER-MAN's Khary Randolph. STAN LEE'S STARBORN tells the story of a regular guy who discovers he's the heir to an intergalactic empire, putting him the center of a war between five alien races.

The revelation this past March of Stan Lee presenting this series of three superhero titles at BOOM! followed on the heels of a viral marketing campaign announcing “Stan’s Back” that hit the internet in late February. The L.A. Times’ Hero Complex & L.A. Times’ Brand-X also got in on the action, running the “Stan’s Back” campaign in print and on their respective websites. TRON Video Game Portfolio Release Date Set for December 7, 2010 in North America





BURBANK, Calif. — (August 30, 2010) – Disney Interactive Studios today announced a collector’s edition of TRON: Evolution will be available at retail. The TRON: Evolution collector’s edition package will include an exclusive TRON light cycle collectible based on the in-game model from TRON: Evolution. The light cycle model is being created by renowned collectibles manufacturer Sideshow Collectibles. Available for the Xbox 360® video game and entertainment system from Microsoft and PlayStation®3 computer entertainment system, the collector’s edition will be packaged in a special protective casing with a drawer for the game.



The company also announced December 7 as the North American release date for all its TRON: Evolution video games on popular platforms. TRON: Evolution games will be available for Xbox 360, PlayStation 3 system, Wii™, Windows PC, Nintendo DS™ and PSP® (PlayStation®Portable) system. Wearing rags that nearly disintegrate, Dr. Tom is drawn in the girl’s strange fears, until he discovers that “Cat” is a person of interest to the government, and a very odd group of “people” that don’t seem to be from around here… “here” being our dimension…

“Working with George on this project is a lot of fun,” continued Huehner. “It’s a dark sci-fi/fantasy, that’s not unlike the Twilight Zone in terms of taking an ordinary person and suddenly confronting them with very bizarre events and people. Tom is a total “good” guy, loves his girlfriend, likes his job, and just wants to help people. But when Cat shows up she turns his comfortable world upside down.”

Artist Rebecca Wrigley will provide incentive covers for each issue of the initial DOORWAYS series.

The film will be released without an MPAA rating, marking the widest release of an unrated genre film in more than 25 years.

HATCHET II is having its world premiere this week in London at Fright Fest, the UK's premiere horror and fantasy film festival.

Just as the 80's had their signature murderous maniacs-HALLOWEEN's Michael Myers of Haddonfield and FRIDAY THE 13th's Jason Voorhees of Camp Crystal Lake- the original HATCHET marked the arrival of the latest and most lethal of the genre's stalking murderers: Victor Crowley, a crazed backwoods killer stalking the bayous of New Orleans.



HATCHET II picks up right where the 2007 original film ends, as Marybeth (Danielle Harris fromHALLOWEEN) escapes from the clutches of the deformed, swamp-dwelling killer Victor Crowley (Kane Hodder from FRIDAY THE 13th). Marybeth returns to the Louisiana swamps along with an army of hunters to recover the bodies of her family and exact her revenge against Victor Crowley.
